Terms of Service

These terms govern your use of the Thrust Analytics website and services (“Services”). By subscribing, purchasing, or otherwise using the Services, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to do so.

1. The Services

Thrust provides analytics work on a subscription basis, and one-off (“one-shot”) analyses. You submit requests through a shared request board, and we deliver analysis, models, and reports. We aim to deliver most requests within about 48 hours, but turnaround times are targets, not guarantees, and depend on scope and the data and access you provide.

3. One-shot purchases

A one-shot is a single, well-defined analysis purchased without a subscription. Scope, delivery, and revisions for one-shots are as described at the time of purchase.

5. Intellectual property

Upon full payment, you own the deliverables we create specifically for you. We retain ownership of our pre-existing methods, know-how, templates, and tools, and of anything of general applicability we develop, and we may reuse these to serve other clients. Nothing here transfers ownership of your data to us.

6. Confidentiality

Each party will protect the other’s confidential information and use it only as needed to provide or receive the Services. Your business data is treated as confidential, as described in our Privacy Policy.

7. Scope and exclusions

Requests should be reasonable in scope and appropriate for an analytics service. Larger initiatives may be broken into phases. We may decline requests that are unlawful, outside our expertise, or that would require rights or access we do not have.

8. Not professional advice

Our deliverables are analytical and informational. They are not legal, accounting, tax, or investment advice, and decisions you make based on them are your own. We are not a licensed financial or investment adviser.

9. Refunds

Refunds and our satisfaction guarantee are described in our Refund Policy, which forms part of these terms.

10. Warranties and disclaimers

We provide the Services with reasonable skill and care. Except as expressly stated, the Services are provided “as is,” and we disclaim all other warranties to the fullest extent permitted by law, including fitness for a particular purpose. We do not warrant that the Services will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Services will not exceed the amount you paid to us in the three months before the event giving rise to the claim.

12. Termination

You may stop using the Services at any time by cancelling. We may suspend or terminate the Services for non-payment, breach of these terms, or unlawful use. Sections that by their nature should survive termination will survive.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any disputes arising out of or relating to these terms or the Services.

14. Changes to these terms

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Continued use of the Services after changes take effect means you accept the updated terms.
